TERMS OF SERVICE Marlee Jean's Studio Last updated: 30 September 2026

  1. ABOUT THESE TERMS - Marlee Jean's Studio is operated by Marlee Terry in Newcastle, NSW, Australia. These terms apply to purchases of physical artworks, prints and commissioned artwork for delivery within Australia through our Shopify website at marleejeansstudio.com, Etsy or direct studio orders. They also cover website purchases made after finding our products on Google. They should be read together with our Return and Refund Policy and any product-specific terms provided before purchase. Workshop bookings and other services are outside the scope of these product terms. For purchases through Etsy, Etsy's applicable platform terms, payment rules and buyer protection processes also apply. These studio terms do not override mandatory Etsy rules or restrict your right to use Etsy's dispute process. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
  2. PRODUCT INFORMATION - Please read the product description before purchasing. It identifies the size, materials, format and whether framing or other accessories are included. Styling photographs may show furniture or frames that are not included in the sale. We aim to represent artworks and prints accurately. Screen settings and lighting may produce small differences in displayed colour. Handmade artworks may contain individual texture and brushwork. These characteristics do not excuse a product that is materially different from its description or otherwise fails to meet consumer guarantees. Any art skate decks described as display-only are decorative artworks, not intended for riding.
  3. PRICES AND PAYMENT - Prices on our website and direct quotes are in Australian dollars unless expressly stated otherwise. Etsy may display prices in a currency selected by the buyer. Displayed consumer prices include any applicable GST. Delivery costs and other applicable charges will be disclosed before you complete payment. Payment is made using the methods offered at checkout or agreed in writing for a commission. Commission payment schedules and deposits are set out in the written quote or agreed commission terms.
  4. ORDERS AND AVAILABILITY - Please provide accurate contact and delivery details. If you notice an error, contact us promptly so we can try to correct it before dispatch. Original artworks are generally unique and subject to availability. If an ordered item is unavailable, or a material pricing or description error affects your order, we will contact you to discuss a suitable alternative or refund. We will not substitute an item or charge an additional amount without your agreement.
  5. MADE-TO-ORDER PRINTS AND COMMISSIONS - Production times for made-to-order items will be communicated in the product listing or before payment. For commissions, the agreed scope, materials, dimensions, price, payment stages, revision arrangements and estimated completion time are set out in the written quote and any agreed commission terms. Please confirm that you have permission to provide reference images and to authorise their use for the agreed commission. Any use of your supplied images beyond producing the commission requires an appropriate separate permission or other lawful basis. Contact us promptly if you need to request a change or cancellation. Any change to scope, price or timing must be agreed. The Return and Refund Policy and your statutory rights continue to apply to custom work.
  6. DELIVERY - Delivery options, costs and relevant production or dispatch estimates will be provided before purchase. Transit estimates are estimates unless a delivery date has been expressly guaranteed. If there is a significant delay, delivery damage or a missing parcel, contact info@marleejeansstudio.com so we can investigate and provide an appropriate solution. You do not need to resolve a delivery problem solely with a courier. These terms do not transfer our consumer-law responsibilities to a delivery provider.
  7. RETURNS AND CONSUMER GUARANTEES - We do not accept change-of-mind returns or exchanges. Our Return and Refund Policy explains how we handle faulty, damaged or incorrectly supplied items, return costs and refunds. The full policy is available at https://marleejeansstudio.com/policies/refund-policy. Etsy buyers can also find return information in the relevant listing and shop policies. Your rights under the Australian Consumer Law and any other applicable mandatory law remain unaffected. We do not exclude liability or remedies that the law requires us to provide.
  8. COPYRIGHT AND ARTWORK USE Copyright in artwork, photographs, designs and website content belongs to the relevant rights holder. Except where rights are transferred by agreement or applicable law provides otherwise, purchasing a physical artwork or print does not transfer copyright or grant reproduction or commercial licensing rights. Please obtain the rights holder's permission before reproducing artwork, creating merchandise from it or using it commercially, unless your use is otherwise permitted by law. Any copyright or licensing arrangements for commissioned work should be expressly recorded in the agreed commission terms.
  9. PERSONAL INFORMATION - Our Privacy Policy explains how we handle personal information collected through our website and direct orders. Etsy's Privacy Policy also applies to information handled by Etsy; any seller privacy notice in our Etsy shop explains our use of buyer information from Etsy orders. Providing information to complete an order does not, by itself, constitute consent to receive marketing emails.
  10. UPDATES AND DISPUTES - We may update these terms for future purchases by publishing a revised version. The terms agreed when you placed your order continue to govern that purchase unless we mutually agree otherwise or the law requires a change. Please contact us first if you have a concern so we can try to resolve it. These terms are governed by the laws of New South Wales and Australia, subject to any mandatory laws that also apply. Nothing here prevents you from using a consumer protection agency, tribunal or court available to you under applicable law.
